New policy will severely damage drug supply chain

The task force on drugs pricing has, in its wake, left the entire pharmaceutical industry scampering for cover. Its recommendations could not have come at a worse hour, with the industry already suffering from MRP- based excise duty, value-added tax and fringe benefit tax. If implemented, the new policy could have an adverse impact on this sunrise sector and severely damage the supply chain of life- saving drugs.

Much noise is being made by small-scale pharma companies about the implementation of Schedule ‘M’ and its far-reaching impact on their operations. The product patent regime, Vat and MRP-based excise duty are being seen by these players as draconian acts meant to throttle their growth. Agreed, that the finance ministry’s ill-timed Ordinance on MRP-based excise duty early this year hastened large pharma companies into capacity expansion. The writing, however, was always on the wall for small pharma companies engaged in producing life-saving drugs under conditions that did not match with the prevailing international standards.

Patent Act - Beginning of a new era

The patent law is a step that would help in opening of knowledge centres in the Indian villages and lead us to be a developed economy in the coming decades, feels Harinder S Sikka.
The new Patent Act is seen by many as a demon that has been released by the Parliament to strangle the poor of our country. It is even more shocking to note media giants like the New York Times coming out with misguiding editorials, possibly aimed at stifling India’s strength and prowess in science and technology. While such publications ought to be relegated to the dustbin of the history, it is important yet to analyse threadbare whether the new Patent Act is a sell-out or a well-planned game plan to isolate India at the WTO.
